Terms of Service

Fluenxi is operated by Krishan Kulasinghe, doing business as Fluenxi ("Fluenxi," "we," "us," or "our"), an independent sole proprietorship. These Terms are an agreement between you and Krishan Kulasinghe. Contact us at hello@fluenxi.app.

You accept these Terms by ticking the acceptance control in the app, or otherwise using the Service. Each version carries a version identifier shown at the top of this page; where we issue a materially revised version, we may ask you to accept it again.

You must be at least 16 years old (or older, if your country requires it) to use the Service. If you are under the legal age of majority where you live, you may use it only with the consent of a parent or guardian. By using the Service, you confirm that you meet these requirements and, where parental consent is needed, that your parent or guardian has agreed to these Terms on your behalf.

Some features require an account. You're responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use. You may delete your account at any time from within the app or by contacting us.

The Service is a keyboard application that uses AI language models to convert local languages written in English letters (such as Singlish and Tanglish), and informal or broken English, into natural English, and offers writing tools such as grammar correction, shortening, expanding, and improving English text. The languages and tools available may change over time. Text you submit is sent to our backend and then to a third-party AI provider, which returns the output. A limited offline mode uses translations cached on your device, without any guarantee of coverage.

Some requests are blocked automatically, for example text containing slurs targeting a protected group, credible threats of violence, or sexual content involving minors. A blocked request returns your original text unchanged and still counts towards your usage limit.

We may change, suspend, or discontinue any part of the Service, including temporarily for maintenance, and we may require you to install an update before you can keep using it.

You agree not to use the Service to:

• Submit or generate unlawful, defamatory, obscene, harassing, or infringing content;
• Send spam, phishing, or fraudulent messages, or impersonate any person or entity;
• Attempt unauthorised access to the Service or its infrastructure, or reverse engineer any part of it;
• Interfere with the Service, scrape or bulk-extract its output, or access it through automated means beyond normal use;
• Use the Service or its output to train a competing AI model or product;
• Resell or sublicense the Service, or circumvent usage limits or the rewarded-advertising mechanism;
• Use the Service in any high-risk or safety-critical context, see Section 5.

We may suspend or terminate access for any user who violates this section.

You retain all rights to any text you submit. We claim no ownership of it and don't keep it on our servers, see our Privacy Policy, which forms part of these Terms. You must not submit passwords, payment details, government IDs, or other sensitive information; our automated safeguards are best-effort and not guaranteed to catch everything.

The Service uses probabilistic AI models. Output may be inaccurate, incomplete, or lose the nuance of what you typed, and the same input may produce different output at different times. You are solely responsible for reviewing output before sending or relying on it. Output is not professional, legal, medical, or financial advice, and must not be used in any context where inaccurate or delayed output could cause death, injury, or serious harm.

The Service is currently free, subject to periodic usage limits. You may unlock additional usage by watching an optional rewarded advertisement. Usage limits and reward terms may change, and we may reverse rewards obtained through fraudulent means. Rewards have no monetary value and can't be exchanged for cash.

We don't currently offer paid subscriptions. If we introduce paid plans, pricing and billing terms will be presented to you before any charge, and processed through the Apple App Store or Google Play under their own terms.

The Service depends on third-party providers, including our AI, authentication, hosting, and advertising providers, as described in our Privacy Policy. We're not responsible for the acts, availability, or policies of these providers.

Where you obtain the app through the Apple App Store, the following also applies:

• These Terms are between you and us, not Apple, and we, not Apple, are solely responsible for the app and its content.
• Your licence to use the app is limited to Apple-branded devices that you own or control, as permitted by the App Store Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for it; to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer-protection or privacy claims.
• We, not Apple, are responsible for investigating, defending, settling, and discharging any third-party claim that the app or your use of it infringes that third party's intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app, such as your mobile network or messaging app's terms.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

Questions, complaints, or claims about the app should be sent to us at hello@fluenxi.app. Where you obtain the app through Google Play, your use is additionally subject to the Google Play Terms of Service; Google is not responsible for the app.

The Service, its software, design, and trademarks are owned by us or our licensors. We grant you a limited, personal, non-transferable licence to install and use the application for your own purposes, no other rights are granted. The "Fluenxi" name and logo may not be used without our permission. Feedback you send us may be used by us freely, without compensation to you.

The app includes open-source software. Those components are licensed under their own open-source licences, not these Terms, and nothing in these Terms limits the rights those licences give you. See our Open-Source Licenses page.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS AI-GENERATED OUTPUT WILL BE ACCURATE OR APPROPRIATE FOR ANY PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE PAST 12 MONTHS OR USD 50. THE SERVICE IS PROVIDED FREE OF CHARGE AND THIS ALLOCATION OF RISK IS AN ESSENTIAL BASIS OF THE AGREEMENT BETWEEN US.

Nothing here excludes liability that can't be excluded under the mandatory consumer-protection law that applies to you.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for conduct that violates these Terms or is otherwise harmful to the Service or other users. On termination, any unused usage allowance or reward balance is forfeited. Account deletion is handled as described in our Privacy Policy.

These Terms are governed by the laws of Sri Lanka, and the courts of Colombo, Sri Lanka have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer-protection right you may have under the law of your country of residence. Before starting any proceedings, please contact us at hello@fluenxi.app so we can try to resolve the issue informally first.

We may revise these Terms from time to time; each revision carries a new version identifier and date at the top of this page. Where a change is material and adverse to you, we'll give at least 30 days' notice before it takes effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.

If any part of these Terms is found to be invalid or unenforceable, the rest remains in full effect. If we don't enforce a right or provision, that is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours, for example to a company we form or to a buyer of the Service, provided your rights are not reduced. We're not responsible for any failure or delay caused by events beyond our reasonable control, such as outages at our service providers.
